Welcome to Alfator Co. These Terms of Service (“Terms”) apply to your use of our website and online store, including all related content, features, products, services, and tools (collectively, the “Services”).

Alfator Co. is an independent small business based in Alberta, Canada. Our online store is powered by Shopify, which provides the technology that enables us to operate our online store and provide the Services.

By accessing or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.

These Terms are intended to be clear and understandable. Nothing in these Terms is intended to limit or exclude any rights or remedies that you may have under applicable law.

1. ACCESS AND ACCOUNT

You must be at least the age of majority in your province or territory of residence to enter into a purchase agreement with us. If you allow a minor to use our Services on a device that you own or control, you are responsible for that minor’s use of the Services.

When using our Services or placing an order, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping address.

You agree that the information you provide is accurate, current, and complete and that you will update it when necessary.

If you create an account, you are responsible for keeping your account credentials confidential and for activity that occurs through your account. You must not sell, transfer, or assign your account to another person.

2. OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizing information, and other product information on our website are accurate.

However, the colour and appearance of products may vary depending on your device, screen settings, lighting, and other factors. Product images are provided for illustration and may not perfectly represent the physical item.

Our embroidered products are made to order. Because each item is prepared individually, minor variations in embroidery, placement, thread appearance, or other details may occur.

We may update product descriptions, photographs, prices, availability, and other information from time to time.

We may discontinue products or limit quantities available for purchase. If we do so after you have placed an order, we will contact you where appropriate and provide any refund required by applicable law.

3. ORDERS

When you place an order through our website, you are submitting a request to purchase the products in your cart.

An order is accepted when we send you an order confirmation or otherwise confirm that we have accepted the order.

We reserve the right to refuse or cancel an order where permitted by law, including where there is an obvious pricing or product-description error, suspected fraud or unauthorized activity, inventory or production issues, or circumstances that prevent us from fulfilling the order.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order or affected items.

Please review your order carefully before submitting it. Because our products are made to order, cancellation requests may not be possible once production has started.

Returns and refunds are governed by our Return & Refund Policy.

4. PRICES AND PAYMENT

All prices are displayed in Canadian dollars unless otherwise stated.

Prices, discounts, promotions, and product availability may change from time to time. The price applicable to your order is the price displayed when you place your order, subject to obvious errors.

Applicable taxes, shipping charges, and other charges will be shown at checkout where applicable.

You agree to provide accurate and complete billing and payment information.

By submitting payment information, you confirm that you are authorized to use the payment method provided.

Payments are processed through payment providers made available through our Shopify-powered store. We do not have access to your complete payment card information.

5. SHIPPING AND DELIVERY

Our products are made to order and are generally processed within 3–5 business days before shipment.

Processing time does not include shipping time.

Orders are shipped from Alberta, Canada. Available shipping methods and estimated delivery times are displayed at checkout based on your shipping destination.

We currently ship to Canada and the United States. International shipping may be available for certain destinations.

Delivery dates and shipping estimates are estimates only and are not guaranteed. Delays may occur because of carrier issues, weather, customs processing, incorrect addresses, holidays, or other circumstances outside our reasonable control.

Once an order has been handed to the shipping carrier, the carrier is responsible for transportation and delivery. We will reasonably assist with tracking or shipping issues when possible.

Customers are responsible for providing a complete and accurate shipping address. We are not responsible for delays or additional shipping costs resulting from an incorrect or incomplete address, except where required by applicable law.

For international orders, the customer may be responsible for customs duties, taxes, brokerage charges, or other import fees imposed by the destination country.

Free Shipping

We offer free shipping on orders of $100 CAD or more, subject to the shipping terms and exclusions displayed at checkout.

6. INTELLECTUAL PROPERTY

All content available through our Services, including our name, logo, product designs, embroidery designs, photographs, graphics, text, product descriptions, videos, audio, website design, and other materials, is owned by or licensed to Alfator Co. and is protected by applicable intellectual property laws.

You may use our website and its content for your personal, non-commercial shopping purposes.

You may not copy, reproduce, modify, distribute, publish, sell, create derivative works from, or otherwise commercially exploit our content without our prior written permission.

You may not use the Alfator Co. name, logo, designs, or other trademarks without our prior written permission.

Shopify and its related names, logos, and trademarks belong to Shopify or its respective owners.

All other trademarks appearing on our Services belong to their respective owners.

7. THIRD-PARTY SERVICES AND TOOLS

Our Services may use third-party services, applications, tools, payment processors, shipping providers, analytics providers, or other technology providers.

These third-party services may have their own terms and privacy policies. Your use of those services may be subject to those third-party terms.

We are not responsible for the independent operation, availability, security, or policies of third-party services to the extent permitted by law.

Shopify provides the technology that supports our online store. Purchases made through our store are transactions between you and Alfator Co.

8. THIRD-PARTY LINKS

Our Services may contain links to websites or services operated by third parties.

These links are provided for convenience. We do not control or guarantee the accuracy, availability, security, or privacy practices of third-party websites.

If you choose to visit a third-party website, you do so subject to that website's own terms and policies.

9. SHOPIFY

Our online store is powered by Shopify.

Shopify provides the technology and infrastructure that allow us to offer our Services online. However, purchases made through our store are made directly between you and Alfator Co.

Shopify is not responsible for the products we sell, our order fulfilment, our return policy, or other aspects of transactions between you and Alfator Co., except as otherwise required by law or provided under Shopify's own agreements and policies.

10. PRIVACY

Your use of our Services is also subject to our Privacy Policy.

We collect, use, and disclose personal information as described in that policy and in accordance with applicable privacy laws.

Because our store is powered by Shopify and we use other service providers, personal information may be processed or stored by service providers located outside Canada.

11. CUSTOMER REVIEWS AND FEEDBACK

If you voluntarily submit reviews, comments, photographs, suggestions, ideas, or other content to us (“Feedback”), you represent that you have the right to provide that content.

By submitting Feedback, you grant Alfator Co. a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, modify, and distribute the Feedback for purposes related to operating, improving, and promoting our business and Services.

We may remove or decline to publish Feedback that is unlawful, abusive, threatening, defamatory, misleading, obscene, infringing, or otherwise inappropriate.

You remain responsible for the content you submit.

12. ACCURACY OF INFORMATION

We make reasonable efforts to keep the information on our website accurate and up to date.

However, occasional typographical errors, inaccuracies, omissions, or outdated information may occur, including in product descriptions, pricing, promotions, availability, shipping information, or other content.

If an obvious error affects an order you have placed, we may contact you to explain the issue and, where appropriate, provide you with the option to confirm the corrected order or receive a refund for the affected item.

Termination does not affect rights or obligations that arose before termination or provisions that are intended to continue after termination.

We provide our Services and products in accordance with applicable law.

Except where expressly provided or required by law, we do not guarantee that our website will always be available, uninterrupted, secure, or error-free.

Nothing in these Terms excludes, restricts, or limits any warranty, guarantee, condition, right, or remedy that cannot legally be excluded or limited under applicable law.

Nothing in these Terms is intended to limit your rights under Alberta's consumer protection legislation or other applicable consumer protection laws.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Alfator Co. and its owners, employees, contractors, service providers, and affiliates will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from your use of our Services.

This may include loss of profits, revenue, business opportunities, data, or similar losses, except where such liability cannot legally be excluded or limited.

Nothing in these Terms limits liability or excludes any rights or remedies where doing so would be prohibited by applicable law.

18. INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses or reasonable costs arising from your unlawful use of the Services, your intentional misuse of the Services, or your violation of these Terms or the rights of another person.

Nothing in this section requires you to indemnify us for matters caused by our own negligence, unlawful conduct, or other circumstances where such an obligation cannot legally be imposed.

The remaining provisions will continue to apply to the fullest extent permitted by law.

If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies expressly incorporated into these Terms, form the agreement governing your use of our Services.

If there is a conflict between these Terms and a specific policy relating to a particular transaction, the more specific policy will apply to that transaction to the extent of the conflict.

Nothing in these Terms limits any rights that cannot legally be waived.

You may not transfer your rights or obligations under these Terms without our prior written consent, except where permitted by applicable law.

We may transfer or assign our rights and obligations in connection with a sale, restructuring, reorganization, or other business transaction, subject to applicable law.

These Terms and your use of our Services are governed by the laws of the Province of Alberta and the applicable laws of Canada, without regard to conflict-of-law principles.

Subject to any mandatory rights or remedies available to consumers under applicable law, disputes relating to these Terms or transactions with Alfator Co. will be subject to the jurisdiction of the courts of Alberta.

Nothing in this section prevents you from exercising a right or remedy that cannot legally be restricted by a contractual choice of jurisdiction.

The headings in these Terms are provided for convenience only and do not affect the interpretation of the Terms.

24. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, Services, legal requirements, or other circumstances.

When we make changes, we will update the “Last updated” date at the top of this page.

Where required by law, we will provide additional notice of material changes.

Your continued use of our Services after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
